Employers who anticipate hiring new H-1B employees under the FY2014 cap (for employment beginning October 1, 2013) should be aware that the first day to submit petitions for new H-1B employment is April 1, 2013. The U.S. Citizenship and Immigration Service (USCIS) only grants H-1B status to 65,0000 workers each year, on a first come, first served basis, and the cap is often filled soon after the filing season opens. For the best chance at getting H-1B visas under the cap, we recommend that petitions for new H-1B employment be delivered to USCIS no later than April 1. (Petitions for extensions and transfer of existing H-1B status may be filed throughout the year).
