Gregory M. Garrett

“As both a litigator and as business counsel, I never lose sight of the human aspect of what I do. While I work tirelessly to obtain the optimal outcome whether in a dispute or a deal, I also understand that my role involves providing clients with clarity and the confidence of knowing their lawyer has their back.”

A formidable and experienced litigator who leverages his courtroom insights to provide sound, actionable business guidance in an outside general counsel role, Greg serves as a trusted advocate and counselor for a wide range of businesses and professionals. While Greg is especially well-versed in protecting the interests, reputations, and livelihoods of healthcare providers and entities, his absolute commitment to his clients and relentless efforts to obtain the best possible result extends to every aspect of his practice.

With a reputation for leaving no stone unturned in his efforts to defend clients from potentially catastrophic claims, Greg provides robust defense for his health care clients in medical malpractice, HIPAA and data privacy, insurance coverage, and other matters. His deep knowledge of the complex and intersecting laws and regulations governing the health care industry also facilitates his counseling on fraud and abuse issues, including those involving the Stark Act and Anti-Kickback Statute, as well as the Medicare Secondary Payer Act and Section 111 Reporting. He has served as lead counsel in trials and other matters in state and federal courts in Maryland, Virginia, and the District of Columbia, as well as the Office of Medicare Hearings and Appeals and the Office of Administrative Hearings.

Beyond his advocacy on health care matters, Greg brings his extensive litigation experience and acumen to bear in a broad spectrum of commercial disputes. He treats every case with the same urgency and importance as his clients, recognizing the stakes and requirements to achieve favorable, ideally early, resolutions. He handles matters involving breach of contract and business torts, intellectual property infringement, antitrust and trade regulation, franchising, and almost every other type of disputed issue that businesses may face.

Greg uses his understanding of how and why business disputes arise, the potential risks that follow, and the approaches needed to avoid or mitigate those risks to provide actionable advice to businesses of all kinds, including manufacturers and distributors. As outside general counsel, Greg assists clients with entity formation and governance, transactional and real estate matters, employment issues, and mergers and acquisitions, among other issues. His guidance is sophisticated yet practical and delivered in a clear and candid manner.

Active in professional organizations, Greg has served as vice-chair of the Exemptions and Immunities Committee of the ABA’s Antitrust Section, among other roles, and has written numerous articles and book chapters on antitrust issues for the Committee. He has been recognized since 2010 by Maryland Super Lawyers magazine for his business litigation, professional liability defense, and products liability defense practices.
